At FIZ, we strive to provide exceptional service to our users. However, if you encounter any issues or have concerns, we are here to assist you.

Below are the steps to file a complaint:

If you have a concern or simply want to discuss an issue, you can reach out to us through the FIZ platform. Our dedicated team is available to address your concerns promptly.

Please provide the following information:
- Your full name
- The mobile phone number and email address associated with your account
- A description of the issue
- The date the problem began
- Your preferred resolution

Online Form: Alternatively, you can file a complaint using our online form. Fill in the required details, and our team will review your complaint promptly.
Email: You can also email us at support@fiz.co with the details of your complaint. Be sure to include the required information mentioned above.

We will thoroughly review your complaint and respond to you via email. Communication will be in either Portuguese or English. We are committed to addressing your concerns promptly and ensuring your satisfaction with our tools and products. Thank you for choosing FIZ.

1. Agreement

  1. By using the FIZ platform or app (the “Platform”), the user agrees to these Terms & Conditions (“Terms of Service”).

  2. FIZ may revise, amend, or replace these Terms without prior notice. Continued use after updates constitutes binding acceptance.

  3. Any new features or tools introduced to the Platform are subject to these Terms.

  4. The most recent version is always accessible at https://fiz.co/docs.

  5. Violation of any provision may result in suspension or immediate termination of the user’s account.

  6. FIZ does not pre-moderate user-generated content and is not responsible for such content. However, FIZ may, without prior notice, review, monitor, remove, or restrict access to any content that violates applicable laws, regulatory obligations, or these Terms, and may report such content to the appropriate authorities.

2. Account Usage

  1. Users must be 18 years of age or older.

  2. Account creation requires full name, valid email, and other information reasonably requested by FIZ.

  3. Account credentials must not be shared. A user may add authorized users in accordance with their plan entitlements.

  4. The user is responsible for maintaining the confidentiality of access credentials and for all activity under their account.

  5. FIZ disclaims liability for damage or loss resulting from unauthorized account access or misuse.

  6. The user is solely responsible for the accuracy, legality, and integrity of any data submitted to FIZ.

3. Website & App Use

  1. Users may access and manage their account data via the Platform.

  2. FIZ is not liable for direct, indirect, incidental, or consequential damages arising from use of or reliance on the Platform, its content, or third-party links.

  3. FIZ may temporarily or permanently suspend access for maintenance, upgrades, legal compliance, or other operational reasons.

4. Termination and Cancellation

  1. Users may cancel their account through the Platform interface.

  2. Upon cancellation, all user data is subject to permanent deletion without recovery; users must back up their data beforehand.

  3. Cancellation does not entitle the user to a refund of prepaid amounts.

  4. FIZ may suspend or terminate access without notice if the user violates these Terms, applicable laws, or engages in abusive conduct.

5. Paid Services & Subscriptions

  1. Core FIZ Invoicing functionality is and will remain free of charge in perpetuity. This guarantee does not apply to optional add-ons or premium features.

  2. Advanced features and services may be available under paid subscriptions, subject to specific terms.

  3. All payments are billed in advance and are strictly non-refundable, including partial months or unused time.

  4. Upgrades are applied immediately and billed accordingly. Downgrades may require confirmation and FIZ approval.

  5. Subscriptions do not renew automatically by default. Renewal must be confirmed by the user per instructions provided via email.

  6. FIZ may adjust pricing with 30 days’ notice, published via the Platform or direct communication.

  7. Inactive accounts may be subject to administrative fees, as disclosed in the pricing policy.

6. Copyright & Intellectual Property

  1. All rights to the Platform, including software, trademarks, logos, and content (except user-submitted data), are owned by FIZ.

  2. Unauthorized use, duplication, reproduction, distribution, or reverse engineering of any part of the Platform is prohibited.

  3. User-generated content remains the property of the user; however, FIZ may store, process, and use such content for service delivery, support, or legal compliance.

7. General Conditions

  1. The Platform is provided on an “as-is” and “as-available” basis. FIZ makes no warranties, express or implied.

  2. Technical support is available via email for both free and paid users, except where overdue payments exist.

  3. The Platform relies on third-party hosting and technology providers.

  4. Users may not attempt to interfere with, disrupt, or gain unauthorized access to the Platform.

  5. Users may not transmit malware, spam, or any malicious or automated scraping software through the Platform.

  6. FIZ does not warrant the Platform will meet all user expectations or be error-free, uninterrupted, or secure.

  7. Users accept the risk of temporary outages or interruptions due to maintenance, updates, or external dependencies.

8. Privacy & Data Protection

  1. FIZ collects and processes personal data in accordance with GDPR and other applicable data protection laws.

  2. Data is processed solely for legitimate purposes necessary for delivering, improving, and supporting the Service.

  3. Personal data will never be sold. It may be shared with third-party processors under strict confidentiality and security obligations.

  4. Users have the right to access, rectify, or request deletion of their data, subject to legal obligations.

  5. Upon account termination, FIZ may retain user data for audit, compliance, dispute resolution, or operational continuity for a duration determined at its sole discretion.

9. Jurisdiction & Disputes

  1. These Terms are governed exclusively by the laws of Portugal, without regard to conflict-of-laws rules.

  2. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal. The parties will first seek amicable resolution before initiating formal proceedings.

  3. Claims must be initiated within 12 months of the alleged cause of action or they will be deemed waived.

10. Tax Guarantee

  1. Availability & linkage to plan level. The Tax Guarantee is available only in plans where it is expressly included. Coverage limits are tied to the user’s active plan on the filing date as published on the pricing page. Current coverage tiers include: up to €500 per declaration; or up to €1,500 per declaration (maximum coverage tier).

  2. Scope. The Tax Guarantee applies exclusively to tax returns prepared and filed by FIZ through the Platform after the user’s onboarding date. It does not apply to returns filed before onboarding or outside the Platform.

  3. What is covered. Additional tax assessed by the competent tax authority and statutory interest directly and solely resulting from a calculation error attributable to FIZ in a covered return, up to the per-declaration limit tied to the user’s plan.

  4. What is not covered. The Guarantee does not cover: late filings or penalties for late/failed submissions; fraud, intentional errors, or deliberate omissions; inaccurate, incomplete, missing, or untimely data, records, or documents from the user; changes in law or administrative interpretation (including retroactive effects) after filing; third-party failures outside FIZ’s control; professional representation costs; indirect, special, punitive, or consequential losses.

  5. Duration. The Guarantee remains valid for 2 years after filing of the covered return, regardless of whether the user maintains a paid subscription.

  6. Assistance with tax-authority queries. FIZ will provide reasonable assistance in responding to official queries from the tax authority relating to a covered return.

  7. Claims process. The user must notify FIZ within 10 days of becoming aware of any tax-authority notice concerning a covered return and provide all requested documentation. FIZ may audit the underlying data and request further information as a condition for assessment.

  8. Subrogation. If FIZ makes a payment under the Guarantee, FIZ is subrogated to the user’s rights against third parties to the extent of such payment.

  9. Relationship with liability cap. Payments under this Guarantee are counted toward, and do not exceed, the overall aggregate liability cap set forth in Section 12.2. The per-declaration limits (€500 / €1,500) apply individually, but in no case shall cumulative payments exceed the €3,000 aggregate cap.

  10. Right to deny or terminate coverage. FIZ reserves the right to deny or suspend the Guarantee where there is reasonable suspicion of fraud, abuse, or misrepresentation by the user.

11. Responsibility for Invoicing & Filings

  1. User-issued invoices. FIZ is not responsible for invoices incorrectly issued by the user. The user remains solely responsible for ensuring the accuracy and lawfulness of all invoices and underlying data.

  2. Pre-onboarding filings. FIZ bears no responsibility or liability for tax returns filed before onboarding or for any liabilities arising from such filings.

  3. User verification duty. The user is solely responsible for verifying the completeness and correctness of all information provided for drafting and filing any returns through the Platform.

12. Limitation of Liability

  1. To the maximum extent permitted by law, FIZ disclaims liability for any indirect, incidental, punitive, or consequential damages, including loss of data, revenue, profits, or business opportunity.

  2. Aggregate cap. FIZ’s total aggregate liability per user, whether arising from contract, tort, statutory duty, or otherwise, and including all amounts payable under the Tax Guarantee, shall not exceed €3,000 (three thousand euros) in total. This cap applies regardless of the number of declarations filed, the number of claims submitted, or the coverage level selected.

  3. Nothing in these Terms limits liability where such limitation is prohibited by law.
